Indian overseas recruiters and recruits often find themselves in a situation which can be compared to the state of chakravyu in Mahabharata where Abhimanyu got himself into and was clueless how to get out of it. The objective of this handbook, therefore, is to provide the basic knowledge of the Emigration Act, 1983 and the Emigration Rules, 1983 in a clear and simple language to migrate the possibility of the state of Chakravyu. The handbook will benefit all stakeholders involved in overseas recruitment – workers, recruiters, lawyers, Indian Missions, embassies in India, emigration consultants and any person or organisation as it deals with the do’s and don’ts of Indian overseas recruitment.
  2. The forthcoming publication, ‘PREVENTION AND PROTECTION FROM SEXUAL HARASSMENT OF WOMEN AT WORKPLACE will be ready for distribution by the end of September, 2022. This book we hope will be an excellent source of understanding what is sexual harassment under the law, “SEXUAL HARASSMENT OF WOMEN AT WORKPLACE (PREVENTION, PROHIBITION AND REDRESSAL) Act, 2013 and the RULES, 2013.

It IS EXPECTED TO PROVIDE THE ‘Dos’ and ‘Don’ts’ under the Act.

A short background of the book is given below to understand the purpose for which the Book is printed:

The book, Prevention & Protection from Sexual Harassment of Women at Workplace focuses on the creation of a sensitized awareness among men and women about harassment at workplace from gender discrimination, patriarchal manacles and fundamental rights guaranteed under the Constitution of India. The book will help woman employees to comprehend the impact of POSH Act in liberating and empowering women employees against harassment or assault at the workplace by putting an end to all kinds of gender polarization – a thorn in the flesh of every working woman. Due to the discrimination at the workplace the women workers are not recognized in their competency and equality in performing jobs at the workplace, irrespective of the level of jobs they are placed.

THE SEXUAL HARASSMENT OF WOMEN AT WORKPLACE (PREVENTION, PROHIBITION AND REDRESSAL) ACT, 2013, hereinafter known as THE POSH ACT, is the only women centric Act, incorporating various aspects of women’s rights. The Act also covers the various rights guaranteed by the Constitution of India to every woman worker to work without the fear of discrimination. The Act recognizes the fact that any kind of sexual assault or harassment is a violation of human rights and a threat to equal opportunities at the workplace, affecting the dignity of women workers. Such assault or harassment will have negative effect on the reputation and productivity of the Organization as well.

The Employer, whether a large corporation or a small enterprise, should strive for creating awareness among the workers to create a diverse and inclusive work environment. The Employer should also conduct special programmes among the workers and the members of the Internal Committee to educate them regarding the importance of the POSH ACT and drive home the fact that sexual harassment of women workers at workplace is a violation of the fundamental human right and equality and not just a matter of labour law violation.

The book on PREVENTION AND PROTECTION FROM SEXUAL HARASSMENT OF WOMEN AT THE WORKPLACE presents in simple terms without using any legalese or legal jargon, so that the common man can easily comprehend and understand the intricacies of the Act.

Since the Act covers all types of workers - permanent, temporary, contract workers, apprentice, trainee or students or domestic workers and also those who are visitors to a workplace, it is important to know the intricacies of the Act.

This book is expected to serve as a source of inspiration to help, conduct and build an enabling work environment where women workers could work in peace and harmony. This will contribute to create an egalitarian society where every individual could work without any discrimination on account of gender difference, caste, race, religion, or political affiliation and work in a friendly atmosphere without any fear of harassment and contribute towards the economic development of the nation.

The objective of this book is to help to create the confidence in every woman worker, without discrimination of any kind, that a diverse and inclusive work environment will bring the best result in their work leading to optimum productivity of the organization. This is all the more important since the women workers are entering into the jobs which were traditionally held by men.
